This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use Zen Prep mobile applications, visit our website, contact us, request support, submit feedback, or otherwise interact with Zen Prep.

Zen Prep is designed with privacy in mind. Our mobile applications do not require users to create an account. We do not sell personal information, use personal information for targeted advertising, or use customer-support information for marketing.

1. Scope of This Privacy Policy

This Privacy Policy applies to:

  • Zen Prep-branded mobile applications distributed through the Apple App Store;
  • the Zen Prep website;
  • contact and support forms;

This Privacy Policy does not govern the independent privacy practices of Apple or other third parties that operate under their own privacy policies.

2. Information We Collect

A. Information Collected Through Ordinary App Use

Zen Prep applications do not require users to create an account.

You are not required to provide us with your name, email address, phone number, physical address, password, or similar identifying information simply to use our applications.

We do not intentionally request personal information from users through the ordinary use of our applications except where a user voluntarily initiates an interaction with us, such as contacting support or submitting feedback.

Information that remains solely on your device and is not transmitted to us is not collected by Zen Prep.

B. Information You Voluntarily Provide

We may receive personal information when you voluntarily:

  • contact us by email;
  • submit a contact or support form;
  • request customer support;
  • provide feedback;
  • report a technical issue;
  • report a question or answer that you believe may be incorrect; or
  • otherwise communicate with us.

Depending on the interaction, this information may include:

  • your name;
  • your email address;
  • the Zen Prep application you are contacting us about;
  • the content of your message;
  • information about a question, answer, or technical issue you report;
  • screenshots or attachments you voluntarily provide; and
  • other information you choose to include in your communication.

Providing this information is voluntary. However, we may be unable to respond to or resolve a request if we do not receive enough information to understand the issue or contact you.

Please do not send sensitive personal information unless it is genuinely necessary for us to address your request.

C. App Store Purchases and Subscriptions

Purchases and subscriptions for Zen Prep iOS applications are processed through the Apple App Store.

Zen Prep does not receive or store your complete credit or debit card number, banking credentials, or other full payment information.

Apple may make limited purchase-related information available to us where necessary to provide purchased functionality, verify access, or resolve a support issue. This may include information such as:

  • product or subscription identifiers;
  • purchase or subscription status;
  • entitlement status;
  • transaction identifiers; or
  • similar limited transaction information.

Apple processes App Store payments and associated information according to its own privacy practices.

D. Website and Technical Information

When you visit our website, our website hosting, infrastructure, security, and form providers may automatically process limited technical information necessary to operate, secure, and maintain the website.

This information may include:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • date and time of access;
  • server logs;
  • technical identifiers;
  • cookie or similar identifiers; and
  • information used to detect automated, fraudulent, or abusive activity.

Security technologies such as CAPTCHA or similar tools may also process limited technical information to distinguish legitimate users from automated or abusive activity.

We do not use this information to build advertising profiles or track users across unrelated websites or applications for advertising purposes.

E. Aggregated and De-Identified Information

We may use information that has been aggregated or de-identified so that it can no longer reasonably be associated with an identifiable individual.

We may use such information for legitimate purposes such as:

  • understanding general service performance;
  • identifying technical problems;
  • improving our applications and website;
  • evaluating content quality;
  • improving reliability; and
  • internal statistical, research, or operational purposes.

Where information has been effectively anonymized so that an individual can no longer reasonably be identified, it is no longer treated as personal information to the extent permitted by applicable law.

3. Sources of Information

We receive personal information primarily:

  • directly from you when you contact or communicate with us;
  • automatically through limited website, server, cookie, or security technologies;
  • from Apple where limited transaction or entitlement information is necessary; and
  • from service providers acting on our behalf where necessary to operate our services.

We do not purchase personal information from data brokers.

4. How We Use Information

We may use information for the following purposes:

  • responding to questions and customer-support requests;
  • investigating technical problems;
  • investigating reports regarding potentially incorrect questions or answers;
  • correcting content or technical issues;
  • providing and maintaining our applications and website;
  • verifying subscription or purchase access where necessary;
  • improving the reliability, quality, and security of our services;
  • understanding general service performance;
  • preventing fraud, abuse, misuse, and security incidents;
  • protecting Zen Prep, our users, and our services;
  • maintaining appropriate business and support records;
  • complying with applicable laws, regulations, court orders, and lawful governmental requests;
  • establishing, exercising, or defending legal claims;
  • enforcing our agreements and protecting our legal rights; and
  • completing a corporate transaction where permitted by law.

We do not use information submitted through customer support, email, contact forms, feedback, or error reports for advertising or marketing purposes.

We do not use personal information for automated decision-making or profiling that produces legal or similarly significant effects on individuals.

5. Legal Bases for Processing

Where the European Economic Area (“EEA”), United Kingdom, or another jurisdiction requires us to identify a legal basis for processing personal information, we rely on one or more of the following bases, as applicable.

Performance of a Contract

We may process information where necessary to provide services you have requested or purchased or to take steps at your request in connection with those services.

Legitimate Interests

We may process information where reasonably necessary for our legitimate interests, including:

  • providing customer support;
  • maintaining and improving our services;
  • investigating and correcting errors;
  • ensuring security and reliability;
  • preventing fraud and abuse;
  • maintaining appropriate business records; and
  • establishing, exercising, or defending legal claims.

We rely on legitimate interests only where those interests are not overridden by your rights and interests under applicable law.

Compliance With Legal Obligations

We may process personal information where necessary to comply with applicable laws, regulations, court orders, tax or accounting requirements, or other legally binding obligations.

Consent

Where applicable law requires consent for a particular type of processing, we will obtain consent before conducting that processing.

Where processing is based on consent, you may withdraw your consent at any time, subject to applicable law.

6. How We Disclose Information

Zen Prep does not disclose personal information except as described in this Privacy Policy or where otherwise permitted or required by law.

Service Providers

We may provide limited personal information to service providers that perform services on our behalf, including providers of:

  • website hosting and website functionality;
  • contact forms;
  • email and communications;
  • cloud and technical infrastructure;
  • software infrastructure;
  • security and fraud prevention;
  • customer support;
  • legal services;
  • accounting services; and
  • other professional services.

These providers may process information only as reasonably necessary to provide their services and subject to applicable contractual and legal obligations.

Where a service provider processes personal information on our behalf, we take appropriate steps designed to require protection of that information consistent with applicable law.

Legal Requirements and Protection of Rights

We may disclose information if we reasonably believe disclosure is necessary to:

  • comply with applicable law;
  • comply with legal proceedings, court orders, or lawful governmental requests;
  • investigate fraud, misuse, or security incidents;
  • protect our rights, property, or services;
  • protect users or other individuals from harm; or
  • establish, exercise, or defend legal claims.

Business Transactions

If the business operating Zen Prep becomes involved in a merger, acquisition, financing, restructuring, sale of assets, change of control, insolvency proceeding, or similar corporate transaction, information may be transferred in connection with that transaction where permitted by law.

Any personal information transferred in such circumstances will remain subject to applicable privacy obligations.

7. No Sale, Targeted Advertising, or Marketing Use

Zen Prep does not sell personal information.

We do not:

  • sell personal information to data brokers;
  • share personal information for cross-context behavioral advertising;
  • use personal information for targeted advertising;
  • track users across unrelated third-party applications or websites for advertising;
  • build advertising profiles based on personal information; or
  • use customer-support information for direct marketing.

For purposes of U.S. privacy laws that define terms such as “sale,” “sharing,” or “targeted advertising,” our current practices do not involve those activities.

We have not knowingly sold personal information or shared personal information for cross-context behavioral advertising.

8. Cookies and Similar Technologies

Our website uses cookies and similar technologies to operate, secure, and maintain the website and, depending on the technologies enabled on the website and your preferences, may use functional or analytics technologies.

Cookies and similar technologies may be used for purposes such as:

  • providing essential website functionality;
  • maintaining security and preventing fraud or abuse;
  • remembering privacy and cookie preferences;
  • enabling contact forms and other website features;
  • maintaining technical performance and reliability; and
  • where enabled and permitted by your preferences, understanding general website usage and performance.

Where required by applicable law, non-essential cookies and similar technologies will not be activated until you provide consent.

When you visit our website, you may be presented with a cookie consent banner that allows you to accept, reject, or manage categories of non-essential cookies.

Where available, you may change or withdraw your cookie preferences through the cookie settings provided on the website.

Essential cookies that are necessary for the operation, security, or functionality of the website may be used without consent where permitted by applicable law.

Zen Prep does not use cookies or similar technologies for behavioral advertising or to track users across unrelated websites or applications for advertising purposes.

Third-party service providers used to operate our website may place or process cookies or similar technical information in accordance with the permissions you provide, applicable law, and their respective privacy obligations.

If our use of cookies or similar technologies materially changes, we will update this Privacy Policy and our cookie consent mechanisms as required by applicable law.

9. Data Retention

Support communications and related personal information are generally retained for up to 24 months after the relevant request or issue has been resolved, unless a longer retention period is reasonably necessary to comply with legal obligations, prevent fraud or abuse, maintain appropriate business records, or establish, exercise, or defend legal claims. Other personal information is retained only for as long as reasonably necessary for the purposes for which it was collected.

The appropriate retention period depends on circumstances including:

  • the nature of your communication;
  • how long it takes to resolve a support request or reported issue;
  • whether information is necessary to maintain appropriate business records;
  • security and fraud-prevention requirements;
  • applicable statutes of limitation;
  • the possibility of legal claims; and
  • legal, regulatory, accounting, or tax requirements.

Once personal information is no longer reasonably necessary, we will delete, anonymize, or otherwise dispose of it in accordance with applicable law and our normal information-management practices.

Deleted information may remain temporarily in backup or archival systems until those systems are overwritten or deleted according to their normal retention cycles.

10. International Data Transfers

Zen Prep is operated from the European Union.

Some of our service providers may process information in the United States or other countries outside your country of residence.

Where personal information subject to the GDPR, UK GDPR, or similar international transfer restrictions is transferred to another jurisdiction, we use an appropriate lawful transfer mechanism where required.

Depending on the circumstances, these mechanisms may include:

  • an adequacy decision;
  • the European Commission Standard Contractual Clauses;
  • UK-approved transfer mechanisms;
  • participation by a recipient in a legally recognized transfer framework; or
  • another transfer mechanism permitted by applicable law.

You may contact us if you would like additional information regarding safeguards applicable to your personal information.

11. Your Privacy Rights

Depending on your place of residence and applicable law, you may have some or all of the following rights regarding your personal information:

  • the right to know whether we process personal information about you;
  • the right to access personal information we maintain about you;
  • the right to obtain information about how personal information is used;
  • the right to correct inaccurate personal information;

  • the right to obtain certain information in a portable format;
  • the right to withdraw consent where processing is based on consent;
  • the right not to be unlawfully discriminated against for exercising privacy rights; and
  • the right to complain to an applicable data protection authority.

To exercise a privacy right, contact us using the information provided below.

We may request information reasonably necessary to verify your identity and protect against fraudulent requests.

Because Zen Prep applications do not require user accounts, we may in some cases possess very little or no information that allows us to identify a particular user.

Where permitted by applicable law, we are not required to collect additional personal information solely for the purpose of identifying an individual whom we otherwise cannot identify.

12. United States Privacy Rights

Residents of certain U.S. states may have additional privacy rights under applicable state law, including rights to:

  • access personal information;
  • obtain information concerning categories of personal information processed;
  • correct inaccurate personal information;

  • obtain a portable copy of certain information;
  • opt out of certain sales or sharing;
  • opt out of targeted advertising or certain profiling;
  • use an authorized agent where applicable; and
  • appeal certain decisions regarding privacy requests where applicable law provides that right.

Zen Prep does not currently sell personal information, share personal information for cross-context behavioral advertising, or use personal information for targeted advertising.

Therefore, opt-out rights relating to those activities generally do not apply to our current practices.

We will not unlawfully discriminate against you for exercising a privacy right.

We do not sell these categories of personal information or share them for cross-context behavioral advertising.

  • government identification numbers;
  • account passwords;
  • complete payment-card information;
  • banking credentials;

  • other highly sensitive information

unless it is genuinely necessary for a particular communication.

If sensitive information is voluntarily submitted to us, we will process it only to the extent reasonably necessary to address the communication, protect our services, or comply with applicable law.

We use reasonable administrative, organizational, and technical measures designed to protect personal information against:

  • unauthorized access;
